ABSTRACT: The enactment of Law no. 12.815/2013 introduced a new regulatory framework of Brazilian port activity. In terms of delineating the civil liability of the port operator, this regulatory framework mirrors, to a large extent, the previously implemented regulatory framework. Although this could represent a signal to solidify the existing framework, it brings together the consolidation of a gap-filled text. The jurisprudential analysis reveals few appreciated cases and research on the doctrine shows a total lack of references on the subject.
